    I would cut the tree right on the neighbors house, with him in it.

    Most state laws only allow the property owner to trim branches that overhang the property line.

    couldn't the dip shit put the panels on a pole to elevate them?

    I'm just laughing inside at the irony... I believe the plaintiff's thought process looks something like: "I'm so environmentally conscience that I have solar panels to reduce my carbon footprint while demanding that my neighbor increase his by cutting down trees so I can live with less guilt" or something to that effect.

    No once they reach a certain size the tree huggers will come out and sit in them so loggers do not cut them, or if they are in a national forest. But you can go to a nursery and buy redwoods to plant in your back yard.

    How long will it take to recoup $70k worth of solar panels???????

    Which landfill will Mr. Vargus' electric car battery end up in when it's spent??

    As far as a waste of courts, locally, here, they wasted untold amounts of time and tax payer's money on deciding if dogs would be allowed to dine with their owners outside at patio diners........

    When it comes to neighbor pissing contests....this is nothing. (and it suprises me not that CA has a Solar Shade law...talk about waste of fricking resources!)

    My GF has worked on some unbelievably petty ones as a law clerk. It gets particularly good for the attorneys, and their toy fund, when an HOA is involved.

    At least the guy with the panels is harmed in some way. Don't get me wrong, I think he's full of shit and should piss off, but at least this isn't a case about HOA rule 1,009,887.1A.12 which says your fence must be 73" tall, and yours is 72". Fix it or I'll sue.

    I had heard this story on NPR during the commute a week or so ago during the CA Report. Turns out that this would seem to be the first time anyone has used this law since it was passed back in the 70s during the OPEC nastiness.

    Funny you should mention fences... before hearing about Bioswales at town council, there was an hour long discussion regarding a fence that borders city right of way, and how two feet of it isn't permitted, and the applicant wanted a deviation. The whole thing was so hopelessly screwed.
